DID SOCIAL SECURITY JUST DENY YOUR CLAIM? WHAT YOU CAN DO

 

 

   It's the most common thing in US life.

 You apply for disability and Social Security denies your claim.  It happens in roughly 80 percent of all claims.  The first action is commonly a denial.

So what can you do?  Is there still hope of getting benefits?

YES.  You are just now ready to put on your real case.

An appeal is not just a last chance formality.  Appeals are where a majority of Disability Claims get paid.  It's actually your best chance to win.
 
WHAT YOU MUST DO?
 
If this your first denial, file a Request for Reconsideration (the first appeal) within 60 days of the denial.  The 60-day deadline is very strict and unforgiving.  Don't miss it.
 
Expect to be denied again at "Reconsideration," because over 90 percent of "Reconsideration" request are also denied.  You are positioning yourself to get before an Administrative Law Judge (ALJ).  So, the Reconsideration appeal is not a waste of time.  It's a step you must take.
 
When "Reconsideration" is denied, appeal again and this will take you to a hearing before an Administrative Law Judge (ALJ).  The judge can ignore and reverse all previous denials and probably will allow back pay, back to date of your disability onset.  Sometimes, this is tens of thousands of dollars as a lump sum payment, in addition to ongoing monthly payments.
